Contests – Terms and Conditions

§ 1 General This contest is not affiliated with Instagram and is in no way sponsored, endorsed, or organised by Instagram. The recipient of the information provided by users is not Instagram, but solely the organiser.

§ 2 Start and End The contest period is determined by the respective Instagram contest post. The start and end times stated therein are binding. Entries received outside the period specified in the post will not be considered.

§ 3 Prize and Participation The prize offered as part of the contest is determined by the respective Instagram contest post. The type, scope, and number of prizes can be found exclusively in the corresponding post. A cash payout, exchange, or transfer of the prize is excluded unless otherwise stated in the post.

The winner will be determined after the period specified in the contest post has ended. Notification will be sent via Instagram direct message to the winning account. If no response is received within a reasonable period, the prize may be re-awarded.

Participation is free of charge and independent of the purchase of any goods or services from the organiser.

Only natural persons who have reached the age of 16 are eligible to participate.

To enter the contest, participants must like and share the contest post on the Instagram account of Mountain Hotel Luis during the participation period. In addition, participants must follow the Instagram page of Mountain Hotel Luis.

The prize may be redeemed from the time the winner is notified, within the period specified in the respective contest post. After the redemption deadline has passed, the prize expires without replacement.

§ 4 Exclusion from Participation

The organiser expressly reserves the right to exclude individuals from the contest if they violate the terms and conditions or do not meet the stated requirements.

In particular, the organiser reserves the right to exclude participants who provide incorrect information, manipulate or attempt to manipulate the contest, or otherwise violate the terms and conditions.

Employees of the organiser, as well as all employees of affiliated companies and/or cooperation partners, are excluded from participation in any case.

§ 5 Execution and Processing

Winners will be selected from all participants by means of a random generator.

The winner will be determined after the period specified in the contest post has ended. Notification will be sent via Instagram direct message to the winning account. If no response is received within a reasonable period, the prize may be re-awarded.

A cash redemption, exchange for other goods, or transfer of the prize to another person is not possible. The prize will be available for collection at the nearest Mountain Hotel Luis. A valid ID must be presented upon collection.

If a participant does not confirm acceptance of the prize within two weeks, a new winner will be drawn from among the participants.

The same applies if a winner declines the prize or provides incorrect contact details, making it impossible to deliver the prize; the organiser is not obliged to research correct addresses.

The method of prize handover will be agreed individually with the winner via private message. There is no entitlement to a specific method or location of handover.

Each winner is solely responsible for the accuracy and completeness of their contact details.

The data required for the handover of the prize will be collected directly from the winner as part of the prize notification process and treated with strict confidentiality (see § 7 Privacy Policy).

§ 6 Early Termination

The organiser expressly reserves the right to modify, suspend, or terminate the contest at any time without prior notice and without stating reasons.

The contest will in particular be terminated early if proper execution cannot be guaranteed for technical reasons (e.g. errors or manipulation affecting the hardware and/or software used) or for legal reasons. If an early termination of the contest results from the conduct of a participant or third party, the organiser may claim compensation for damages incurred from such persons.

§ 7 Privacy Policy (Consent Clause)

Contest participants acknowledge that the organiser collects and stores their Instagram usernames for the purpose of conducting the contest. No further processing of participant data, such as for advertising purposes, takes place.

In the event of a win, the winner’s full name, postal address, and if applicable telephone number and/or email address will additionally be collected and stored for the purpose of prize handover, and may be passed on to third parties (e.g. postal services, parcel delivery services, etc.) for the purpose of delivering the prize.

The data collected is used solely for identification, prize notification, and prize handover; it will be blocked from further use after the final processing of the contest and deleted after the statutory retention periods have expired.

Contest participants may at any time request information from the organiser about which personal data is stored.

Furthermore, contest participants may at any time request the correction or deletion of their data. However, further participation in contests will be excluded in such cases.

In addition, contest participants agree that in the event of a win, their Instagram username will be mentioned and linked on the Mountain Hotel Luis Instagram page.

This consent may be withdrawn at any time without stating reasons, in writing to:

Mountain Hotel Luis GmbH reserves the right to delete entries or data of contest participants without stating reasons.

§ 8 Legal Recourse, Liability, and Other Provisions

Legal recourse is excluded. Place of jurisdiction is Zell am See.

The laws of the Republic of Austria apply exclusively. The application of the UN Convention on Contracts for the International Sale of Goods is excluded.

The organiser is not liable for damages arising from the contest, unless such damages were caused by the organiser through gross negligence or wilful misconduct, in particular through injury to life, body, or health of participants.

Should individual provisions of these terms and conditions be or become invalid, the validity of the remaining terms and conditions shall not be affected. In place of an invalid provision, the provision that comes closest to the intended purpose in a legally permissible manner shall be deemed agreed.
