§ 1 General
This contest is in no way associated with Instagram and is not sponsored, supported, or organized by Instagram. The recipient of the information provided by users is not Instagram but exclusively the organizer.
§ 2 Start and End
The contest period is stated in the respective Instagram contest post. The start and end times indicated there are binding. Entries received outside the period specified in the post will not be considered.
§ 3 Prize and Participation
The prize offered in the contest is specified in the respective Instagram contest post. The type, scope, and number of prizes are exclusively derived from that post. Cash payment, exchange, or transfer of the prize is excluded unless otherwise stated in the post.
The winner will be determined after the end of the contest period indicated in the post. Notification will be sent via direct message on Instagram to the account selected as the winner. If the winner does not respond within a reasonable period, the prize may be reallocated.
Participation is free and independent of the purchase of goods or services from the organizer.
Only natural persons who have reached the age of 16 are eligible to participate in the contest.
To participate, users must like and share the contest post on the Instagram account of Mountain Hotel Luis during the participation period. Furthermore, participants must follow the Mountain Hotel Luis Instagram page.
The prize can be redeemed starting from notification of the winner for the period specified in the Instagram contest post. After the redemption period expires, the prize will lapse without replacement.
§ 4 Exclusion from Participation
The organizer expressly reserves the right to exclude any person from the contest if they violate the terms and conditions or fail to meet the stated requirements.
In particular, the organizer reserves the right to exclude participants who provide false information, manipulate or attempt to manipulate the contest, or otherwise violate the contest rules.
Excluded from participation are employees of the organizer, employees of affiliated companies, and/or employees of cooperation partners.
§ 5 Execution and Processing
The winners will be randomly selected from all participants.
The winner will be notified after the end of the contest period indicated in the Instagram post via direct message. If the winner does not respond within a reasonable period, the prize may be reallocated.
The prize cannot be redeemed for cash or other monetary value, nor transferred to another person. The prize will be available for collection at the nearest Mountain Hotel Luis. Winners must present valid identification upon collection.
If a participant does not confirm acceptance of the prize within two weeks, a new winner will be drawn from the pool of participants. The same applies if a winner declines the prize or provides incorrect contact details, making delivery impossible. The organizer is not obliged to investigate correct addresses.
The method of prize delivery will be arranged with the winner via private message. There is no entitlement to a specific type or location of delivery.
Each winner is responsible for the accuracy and completeness of their contact information. The data required to deliver the prize will be collected directly from the winner during prize notification and treated strictly confidentially (see §7 Privacy Policy).
§ 6 Early Termination
The organizer reserves the right to modify, suspend, or terminate the contest at any time without prior notice and without giving reasons.
The contest may, in particular, be terminated early if proper execution cannot be ensured for technical (e.g., errors or manipulation affecting hardware or software) or legal reasons. If early termination results from the behavior of a participant or third parties, the organizer may claim compensation for any resulting damages.
§ 7 Privacy Policy (Consent Clause)
Participants acknowledge that the organizer collects and stores their Instagram usernames for the purpose of conducting the contest. Any further processing of participant data, e.g., for advertising purposes, will not take place.
In the event of a win, the organizer will additionally collect and store the winner’s full name, postal address, and, if applicable, telephone number and/or email address, and may share these details with third parties (e.g., postal or courier services) for prize delivery purposes.
The collected data is used solely for identification, prize notification, and prize delivery; it will be blocked for further use after the contest is completed and deleted after expiration of the statutory retention periods.
Participants may request information from the organizer at any time about which personal data is stored. They may also request correction or deletion of their data. Further participation in the contest is excluded in such cases.
Participants agree that in the event of winning, their Instagram username may be displayed and tagged on the Mountain Hotel Luis Instagram page.
This consent may be revoked at any time without giving reasons in writing to:

Mountain Hotel Luis GmbH reserves the right to delete participant entries or data at any time without giving reasons.
§ 8 Legal Process, Liability, and Other Provisions
Legal recourse is excluded. The place of jurisdiction is Zell am See.
Only the laws of the Republic of Austria apply. The application of the UN Sales Convention is excluded.
The organizer is not liable for damages arising from the contest, except where such damages are caused intentionally or by gross negligence, e.g., in the case of injury to life, body, or health of participants.
Should any provisions of these terms be invalid or become invalid, the validity of the remaining terms remains unaffected. In place of an invalid provision, a provision shall apply that comes closest to the purpose of the original provision in a permissible manner.
