Scope of Application<\/h2>\n<ol start=\"1\">\n<li>These General Terms and Conditions (hereinafter referred to as &#8220;GTC&#8221;) apply to all accommodation contracts and to all additional services and deliveries provided by MOUNTAIN LUIS (hereinafter referred to as the &#8220;Hotel&#8221;).<\/li>\n<li>The operator of MOUNTAIN LUIS and the contracting party on behalf of the Hotel is:<strong>Mountain Hotel Luis Management GmbH<\/strong><br \/>\nNikolaus-Gassner-Stra\u00dfe 19<br \/>\n5710 Kaprun, Austria<br \/>\nCompany Registration Number: FN 513654z<br \/>\nCommercial Register Court: Regional Court of Salzburg<br \/>\nVAT Identification Number: ATU74627004<br \/>\nEmail: <a href=\"mailto:luis@mountain-hotels.com\">luis@mountain-hotels.com<\/a><\/li>\n<li>Deviating agreements and individually agreed booking, payment or cancellation conditions shall take precedence over these GTC.<\/li>\n<li>Any conflicting general terms and conditions of the contracting party shall apply only if the Hotel has expressly agreed to their application.<\/li>\n<li>The contracting party is the natural or legal person who concludes the accommodation contract with the Hotel. A guest is any person who makes use of the booked accommodation services.<\/li>\n<\/ol>\n<h2>II. Conclusion of Contract<\/h2>\n<ol start=\"1\">\n<li>The accommodation contract is concluded upon acceptance of a booking request by the Hotel. Acceptance is generally confirmed by issuing a booking confirmation.<\/li>\n<li>For online bookings, the contract is concluded in accordance with the conditions displayed during the booking process and the subsequent booking confirmation.<\/li>\n<li>The contracting party is obliged to provide complete and accurate information when making a reservation and to inform all accompanying guests about the applicable booking conditions and house rules.<\/li>\n<li>If a booking is made by a third party, that party is obliged to forward all relevant booking information to the guests who will actually be staying at the Hotel. Any liability of the third party for the guests&#8217; obligations shall be governed by the agreements made and the applicable statutory provisions.<\/li>\n<li>Subletting or transferring booked rooms, apartments or other accommodation units to third parties, as well as using them for purposes other than the agreed accommodation, requires the prior consent of the Hotel.<\/li>\n<li>Guests are not entitled to a specific room number or accommodation unit unless this has been expressly agreed upon.<\/li>\n<\/ol>\n<h2>III. Services, Prices and Payment<\/h2>\n<ol start=\"1\">\n<li>The Hotel undertakes to provide the agreed accommodation services in accordance with the booking confirmation and these GTC.<\/li>\n<li>The contracting party is obliged to pay the agreed prices for accommodation and all additional services used. This also applies to services provided by third parties at the request of the contracting party and charged through the Hotel.<\/li>\n<li>Unless otherwise stated, all quoted prices include the applicable statutory value-added tax (VAT). Any additional taxes, fees or other charges will be indicated separately during the booking process or in the offer.<\/li>\n<li>Subsequent changes to the length of stay, number of guests, booked accommodation units or agreed services may result in price adjustments, provided the Hotel agrees to the requested changes.<\/li>\n<li>The Hotel is entitled to request an appropriate deposit or advance payment upon conclusion of the contract. The amount, payment method and due date will be specified in the respective offer or booking confirmation.<\/li>\n<li>Any deposit paid will be credited towards the agreed total price.<\/li>\n<li>Unless otherwise agreed, the outstanding balance must be settled no later than the day of departure.<\/li>\n<li>The Hotel is entitled to issue interim invoices for services already provided during the guest&#8217;s stay.<\/li>\n<li>In the event of late payment, the applicable statutory provisions shall apply.<\/li>\n<\/ol>\n<h2>IV. Cancellation by the Guest and Cancellation Policy<\/h2>\n<p>Occasionally, unforeseen circumstances may prevent guests from taking their long-awaited holiday or cause them to arrive later than planned. In such cases, the following cancellation conditions apply at MOUNTAIN LUIS.<\/p>\n<h3>1. Standard Cancellation Policy<\/h3>\n<p>The following cancellation conditions apply to bookings for which no separate cancellation arrangements have been agreed:<\/p>\n<ul>\n<li>Up to and including <strong>15 days before arrival: free cancellation<\/strong><\/li>\n<li><strong>14 to 8 days before arrival:<\/strong> 50% of the total booking price<\/li>\n<li><strong>7 to 2 days before arrival:<\/strong> 90% of the total booking price<\/li>\n<li><strong>From 1 day before arrival:<\/strong> 100% of the total booking price<\/li>\n<li><strong>In the event of a no-show or early departure:<\/strong> 100% of the total booking price<\/li>\n<\/ul>\n<h3>2. Special Cancellation Policy \u2013 Christmas, New Year&#8217;s Eve and Winter Holidays<\/h3>\n<p>The following special cancellation conditions apply to stays during the Christmas period, over New Year&#8217;s Eve and during the winter holiday periods:<\/p>\n<ul>\n<li>Up to and including <strong>21 days before arrival: free cancellation<\/strong><\/li>\n<li><strong>20 to 15 days before arrival:<\/strong> 50% of the total booking price<\/li>\n<li><strong>14 to 2 days before arrival:<\/strong> 90% of the total booking price<\/li>\n<li><strong>From 1 day before arrival:<\/strong> 100% of the total booking price<\/li>\n<li><strong>In the event of a no-show or early departure:<\/strong> 100% of the total booking price<\/li>\n<\/ul>\n<h3>3. Bookings of More Than Two Accommodation Units<\/h3>\n<p>For bookings of more than two rooms, apartments or other accommodation units, different cancellation and payment conditions may apply.<\/p>\n<p>Such conditions will be communicated to the contracting party before the contract is concluded and agreed upon separately.<\/p>\n<h3>4. Special Offers and Booking Rates<\/h3>\n<p>Different cancellation conditions may apply to special offers, promotional rates, non-refundable bookings or individually agreed packages.<\/p>\n<p>The conditions expressly agreed upon at the time of booking and stated in the booking confirmation shall apply.<\/p>\n<h3>5. Cancellation Procedure<\/h3>\n<ol start=\"1\">\n<li><strong>All cancellations must be made in writing<\/strong>, particularly by email to the Hotel.<\/li>\n<li>The decisive factor for calculating the cancellation period is the date on which the cancellation notice is received by the Hotel.<\/li>\n<li>Any deposits already paid will be offset against the applicable cancellation fees. Any remaining credit will be refunded.<\/li>\n<li>Cancellation fees are calculated based on the agreed total booking price of the cancelled reservation.<\/li>\n<li>Mandatory statutory rights of the guest remain unaffected. Any expenses saved by the Hotel and income generated through alternative rental of the accommodation will be taken into account where required by law.<\/li>\n<\/ol>\n<p>We recommend taking out suitable travel and cancellation insurance to protect against unforeseen circumstances.<\/p>\n<h2>V. Cancellation by the Hotel<\/h2>\n<ol start=\"1\">\n<li>The Hotel is entitled to withdraw from the accommodation contract if an expressly agreed deposit has not been paid by the due date, despite the granting of a reasonable additional payment period.<\/li>\n<li>The Hotel may also withdraw from the contract for important, objectively justified reasons in accordance with applicable statutory provisions.<\/li>\n<li>Such reasons may include, in particular:\n<ul>\n<li>Deliberately providing false information about essential circumstances when making a reservation.<\/li>\n<li>Using the accommodation for purposes that violate applicable laws.<\/li>\n<li>Unauthorised subletting or transfer of the accommodation.<\/li>\n<li>Behaviour by the guest that seriously endangers the safety of other guests or the proper operation of the Hotel.<\/li>\n<\/ul>\n<\/li>\n<li>If the Hotel is unable to fulfil its contractual obligations due to extraordinary and unavoidable circumstances, the applicable statutory provisions shall apply.<\/li>\n<li>The Hotel will inform the contracting party without undue delay of any cancellation and the resulting legal consequences.<\/li>\n<li>Statutory rights of the contracting party, including reimbursement of payments already made or claims for damages where applicable, remain unaffected.<\/li>\n<\/ol>\n<h2>VI. Arrival and Departure<\/h2>\n<ol start=\"1\">\n<li>Booked rooms and apartments are generally available to guests <strong>from 4:00 p.m. (16:00) on the agreed arrival date<\/strong>, unless a different check-in time has been arranged.<\/li>\n<li>Guests are not entitled to earlier access. Early check-in may be arranged subject to availability and may incur an additional charge.<\/li>\n<li>Guests expecting to arrive later than planned are kindly requested to inform the Hotel in advance.<\/li>\n<li>On the agreed departure date, rooms and apartments must be vacated <strong>by 10:00 a.m. (10:00)<\/strong>, unless a different departure time has been agreed.<\/li>\n<li>Late check-out may be arranged subject to availability and may incur an additional charge.<\/li>\n<li>If accommodation is used beyond the agreed departure time without prior arrangement, the Hotel may charge an appropriate additional fee or claim compensation for demonstrable damages in accordance with applicable statutory provisions.<\/li>\n<\/ol>\n<h2>VII. Alternative Accommodation<\/h2>\n<ol start=\"1\">\n<li>If the Hotel is unable to provide the agreed accommodation for important, objectively justified reasons, it may offer the contracting party suitable alternative accommodation of equivalent quality.<\/li>\n<li>The alternative accommodation must, as far as possible, correspond to the originally agreed services in terms of category, facilities and location and must be reasonable for the guest.<\/li>\n<li>Any additional costs associated with equivalent alternative accommodation arranged by the Hotel shall be borne by the Hotel to the extent required by law or contract.<\/li>\n<li>The guest&#8217;s statutory rights, particularly in cases of non-performance or defective performance of the accommodation contract, remain unaffected.<\/li>\n<\/ol>\n<h2>VIII. Use of Hotel Facilities and House Rules<\/h2>\n<ol start=\"1\">\n<li>Guests are entitled to use their booked accommodation and the Hotel facilities included in their agreed package for their intended purposes.<\/li>\n<li>Certain facilities and additional services may be subject to separate opening hours, conditions of use, age restrictions or additional charges.<\/li>\n<li>Guests are obliged to comply with the Hotel&#8217;s house rules and all applicable safety and usage instructions.<\/li>\n<li>All facilities, furniture and equipment must be treated with due care.<\/li>\n<li>Any person who culpably causes damage shall be liable in accordance with the applicable statutory provisions.<\/li>\n<li>The wellness, pool and other leisure facilities must be used in accordance with the applicable safety regulations and usage instructions.<\/li>\n<li>The Hotel reserves the right to temporarily restrict access to individual facilities for operational, technical or safety-related reasons. Statutory rights arising from any impairment of agreed services remain unaffected.<\/li>\n<li>Pets may only be brought to the Hotel by prior arrangement and in compliance with the applicable house rules. Any additional charges will be communicated in advance.<\/li>\n<\/ol>\n<h2>IX. Hotel Liability<\/h2>\n<ol start=\"1\">\n<li>The Hotel shall be liable for damages in accordance with the applicable statutory provisions.<\/li>\n<li>Liability for personal injury, damage to health or loss of life, as well as damage caused intentionally or through gross negligence, shall remain unrestricted to the extent provided by law.<\/li>\n<li>Liability for guests&#8217; belongings, valuables, money and other personal property shall be governed by the statutory provisions concerning innkeepers&#8217; liability, particularly Sections 970 et seq. of the Austrian Civil Code (ABGB).<\/li>\n<li>Guests are requested to report any loss or damage to the Hotel without undue delay to allow for appropriate investigation and documentation.<\/li>\n<li>The use of parking facilities is subject to the applicable statutory provisions and any expressly agreed conditions of use.<\/li>\n<li>Mandatory statutory liability claims remain unaffected in all cases.<\/li>\n<\/ol>\n<h2>X. Wi-Fi and Internet Usage<\/h2>\n<ol start=\"1\">\n<li>Where the Hotel provides Wi-Fi access, guests may use it in accordance with applicable laws and regulations.<\/li>\n<li>Use of the internet connection for unlawful purposes, particularly copyright infringement or the distribution of illegal content, is prohibited.<\/li>\n<li>Guests are responsible for the security of their own devices and data. The use of appropriate security measures is recommended.<\/li>\n<li>The Hotel endeavours to provide a reliable internet connection. However, uninterrupted availability or a specific connection speed cannot be guaranteed unless expressly agreed.<\/li>\n<li>Excessive use of the available bandwidth that significantly affects internet access for other guests is prohibited.<\/li>\n<li>The Hotel&#8217;s statutory liability remains unaffected.<\/li>\n<\/ol>\n<h2>XI. Data Protection<\/h2>\n<ol start=\"1\">\n<li>The Hotel processes personal data in connection with bookings, stays and the provision of agreed services in compliance with applicable data protection legislation, particularly the General Data Protection Regulation (GDPR), the Austrian Data Protection Act (DSG) and the Austrian Telecommunications Act 2021 (TKG 2021), where applicable.<\/li>\n<li>Personal data is processed in particular for handling booking enquiries, fulfilling accommodation contracts, processing payments and complying with legal obligations.<\/li>\n<li>Information regarding the type, scope, purpose and legal basis of data processing, as well as the rights of data subjects, is provided in the Hotel&#8217;s Privacy Policy.<\/li>\n<li>The current Privacy Policy is available on the MOUNTAIN LUIS website.<\/li>\n<\/ol>\n<h2>XII. Final Provisions<\/h2>\n<ol start=\"1\">\n<li>Any amendments or additions to the accommodation contract require the consent of both contracting parties. Mandatory statutory form requirements remain unaffected.<\/li>\n<li>Unless otherwise agreed and to the extent permitted by law, the place of performance and payment shall be the registered office of the Hotel operator.<\/li>\n<li>Austrian law shall apply, subject to mandatory consumer protection provisions. For consumers habitually resident in another country, mandatory protective provisions of the law applicable under the relevant conflict-of-law rules shall remain unaffected.<\/li>\n<li>Any disputes arising from the contractual relationship shall be subject to the applicable statutory rules on jurisdiction. Mandatory places of jurisdiction for consumers remain unaffected.<\/li>\n<li>Should any provision of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
